Title:
Release of S106 Funds for Cycleway/Footpath Improvements in Melbourne Park to provide Footway Lighting.
Subject and Decision Taken
Section 106 funding of £79,580 was provided by Persimmon Homes, related to the site of the former Watts Yard. The funding to be spent before June 2023 on measures to improve the cycleway along the river Petteril at Melbourne Park.

In 2013 when the first part of the funding was provided it was agreed that the funding would be used to provide footway lighting on sections of existing cycleway and new sections of cycleway would be constructed along the river to provide a link to the new development.

Before work could be progressed the 2015 flood resulted in the Environment Agency having to investigate flood prevention measures at Melbourne Park. It was decided that work on the Cycleway would be delayed until the EA had designed and constructed their flood prevention works.

The EA have now completed the main part of their flood prevention work which enables the work to provide footway lighting to take place. This ODN sets out the decision to release £22,175 of the funding to provide the footway lighting works, these involve the provision of a power supply and the installation of new lights.

Work will take this summer so that lighting is in place before winter.

The remaining funds of £57,405 to provide new sections of cycleway cannot currently be spent as the EA still have to undertake further flood prevention works in the area of the allotments. It is likely to be summer 2022 before this element of the work can take place. 

Reason for Decision
To enable the footway lighting to be provided in Melbourne Park now the EA flood prevention works have been completed.
Details of alternative options considered
Do nothing.  The S.106 funds would be returned to the developer and as a result no lighting would be provided to sections of existing cycleway.
